Before deciding to effect a repossession, a dealership should always seek legal counsel. Auto Advisory Legal (AAL) specializes in dealership repossessions. We can help you get your vehicle back and, more importantly, make sure you don’t get into trouble while your doing it.
Our Process
Step 1: Perform Legal Review of Deal Jacket
Before AAL recommends a traditional repossession, we look to make sure the following criteria are satisfied:
- The customer clearly is in material default of the contract; and
- The sale or lease documentation is in order and error free; and
- The dealership is the undisputed legal owner of the vehicle; and
- The vehicle is not being concealed (e.g., parked in a private garage); and
- The repossession can be done peacefully.
Step 2: Prepare and Mail Out Pre-repossession Notice (if required)
Under limited circumstances, a pre-repossession notice is required under California law. If we determine this is necessary, AAL will prepare and mail the required notice.
Step 3: Contract With Licensed, Insured, and Bonded Repossession Agency
We only contract with reputable repossession agencies who are properly licensed and insured. We handle all the paperwork and work directly with the repossession agency so you don’t have to.
Step 4: Keep You Informed
We provide you with regular email updates as to the status of your order.
Step 5: Prepare and Mail Out Post-repossession Notices
Once the vehicle is recovered, we will prepare and mail out the required post-repossession notices. This includes a Notice of Intent to Dispose (under all circumstances) and a Notice of Surplus or Deficiency (under limited circumstances).
